If you access HostingCHS from a mobile device using the HostingCHS mobile application (the "App"), the following terms and conditions (the "App Terms") apply to your use of the App. These App Terms are an agreement between you (“you” or “your”, “HostingCHS”, “we”, “us” or “our” ) and HostingCHS (US). In addition, you hereby accept and agree to the HostingCHS Terms of Service . Your use of the App confirms your acceptance of these App Terms and the HostingCHS Terms of Service .
1. GRANT OF RIGHT OF USE.
HostingCHS grants you the right to use the Application solely for your personal use. You must comply with all applicable laws when using the Application.
2. INTELLECTUAL PROPERTY RIGHTS.
HostingCHS owns or is the licensee of all right, title, and interest in and to the Application, including all patent, copyright, trademark, and all other proprietary rights, whether registered or unregistered, including all applications, renewals, extensions, and restorations thereof. You will not modify, adapt, translate, prepare derivative works from, decompile, reverse engineer, disassemble, or otherwise attempt to derive the source code of any Application, and you will not remove, obscure, or alter any HostingCHS copyright, trademark, or other proprietary rights notices affixed to, contained in, or accessed in conjunction with the Application.
3. EXCLUSIVITY OF CONTRACTUAL RELATIONSHIP.
a. The HostingCHS mobile app is available for installation on the Google Play Store and Apple App Store.
b. You may install the Application only on your personal mobile device.
c. For Android devices, the App Terms are an agreement between you and HostingCHS only. Google and/or Google Play are not parties to these App Terms.
d. For Apple devices, the App Terms are an agreement between you and HostingCHS only. The Apple App Store is not a party to these App Terms.
e. Any issues related to the use of the Application may be directed solely to HostingCHS and not to Google and/or Google Play or the Apple App Store.
4. Additional Policies; Grievance Redressal Officer.
By accepting the HostingCHS Terms of Service, you also agree to comply with all policies and agreements contained and incorporated by reference therein, including, but not limited to, the HostingCHS Privacy Notice and Acceptable Use Policy . 5. Export control
The Application is subject to export control and economic sanctions laws and regulations administered or enforced by the U.S. Department of Commerce, the Department of the Treasury’s Office of Foreign Assets Control (“OFAC”), the Department of State, and other U.S. authorities (collectively, “U.S. Trade Laws”). You may not use the Application to export or re-export, or permit the export or re-export, of software or technical data in violation of U.S. trade laws. Furthermore, by using the Application, you represent and warrant that you are not (a) an individual, organization, or entity organized or located in a country or territory that is the subject of OFAC sanctions (including Cuba, Iran, Syria, Sudan, North Korea, or the Crimea region of Ukraine); (b) designated as a Specially Designated National or Blocked Person by OFAC or otherwise owned, controlled, or acting on behalf of such a person; (c) otherwise a prohibited party under U.S. trade laws; or (d) engaged in nuclear, missile, chemical, or biological weapons activities to which U.S. persons may not contribute without a license from the U.S. government. Obligations under this section will survive any termination or expiration of these App Terms or your use of the App.
