This addendum (“Server Addendum”) also applies to you if you purchased VPS or dedicated server services and is incorporated by reference into the HostingCHS Terms of Service. Unless otherwise stated, the terms defined in this Server Addendum have the meanings provided in the Terms of Service. HostingCHS may modify this Server Addendum at any time without notice.
1. Cancellations and Refunds
a. Customers can cancel their VPS services at any time through the Customer/Reseller Control Panel.
b. For more information about our money-back guarantee and refund policy for VPS services, please see the Cancellations and Refunds section of our Terms of Service.
2. Prohibited uses
A. In addition to the Prohibited Uses described in the Acceptable Use Policy, Customers may not:
a. Use the Services to run public IRCd or malicious bots.
b. Use the Services to run any type of BitTorrent client or tracker that links to or downloads illegal content.
c. Use the Services to run a public/open proxy, or use a proxy to access illegal/malicious content.
d. Use the Services to operate I/O-intensive applications that adversely affect normal server operations.
e. Use the Services in any way that negatively affects normal server operations.
3. Certain rights
a. HostingCHS may take any action to enforce its rights under this Server Addendum or the HostingCHS Terms of Service, including, but not limited to, accessing our server by any means and, if necessary: (i) resetting our server passwords; and/or (ii) suspending the User's access to our server and/or terminating the User's access (and subsequently deleting such User's data from our server).
b. HostingCHS will provide support to the User only if there is a failure with: (i) the hardware of our servers; (ii) the network infrastructure that supports our servers; (iii) the deployment of our servers; (iv) the installation of compatible operating systems, if any; and (v) setting up reverse domain name systems for the Internet Protocol (IP) addresses provided by HostingCHS.
c. Users are advised that they will be solely responsible for: (i) managing IP reputation and taking the necessary steps to remove any blacklisted IPs; (ii) updating and patching the operating system and applications on our server provided to Users; (iii) making changes to our server that affect the display of information in the Customer/Reseller Control Panel.
4. Inodes
a. Generally, accounts may have a default inode limit of 1,000,000 to better protect the file system; however, this limit may vary depending on the package or services you have purchased.
5. cPanels Accounts
a. Our VPS and dedicated server packages include 100 cPanel accounts at no additional charge. However, if you exceed 100 cPanel accounts, you will be billed for each additional cPanel account, based on our then-current rates.
6. Mail Policy
a. VPS accounts will be governed by our Acceptable Use Policy .
7. Backup and data loss
a. HostingCHS does not provide backups for VPS servers. Use of the VPS service is solely at your own risk. HostingCHS is not responsible for the files and/or data residing in your account. You agree to assume full responsibility for all files and data transferred and to maintain all appropriate backups of files and data stored on HostingCHS servers.
