Privacy Notice. Please see the HostingCHS Privacy Notice for more information about what information HostingCHS collects, how it is used, and when it may be disclosed. Subject to the HostingCHS Privacy Notice, this Data Request Policy describes the types of data requests HostingCHS may receive and how HostingCHS may respond to those requests.
Types of Requests. HostingCHS may receive the following types of requests related to its Subscribers:
a) Data Requests. A data request is a request for information or documents related to Subscribers' accounts in connection with official criminal investigations or other legal proceedings. Except in limited emergency situations (see below), HostingCHS requires that data requests be made through formal U.S. legal processes and procedures, and such requests will be handled in accordance with applicable law. Examples of acceptable data requests include:
i. Citations
ii. Court orders
iii. Search warrants
iv. Legal process received from outside the United States may require a Mutual Legal Assistance Treaty (MLAT) with the United States.
v. Other forms of legal process, such as civil investigation claims.
b. Preservation Requests. A preservation request asks HostingCHS to preserve Subscriber account records in connection with official criminal investigations or other official legal proceedings. Preservation requests must include the following information:
i. Identification of the account(s) in question (as described in more detail in Section 6 below);
ii. Identification of the investigating agency and/or specific pending official proceedings (requests must be signed on letterhead of the authorities);
iii. Assurances that the requesting agency or individual is taking steps to obtain the appropriate legal process to access the data that HostingCHS is required to preserve; and
iv. A valid email address and phone number.
3. Emergency Requests. An emergency request is only appropriate in cases involving imminent serious bodily harm or death. We respond to emergency requests when we believe in good faith that such harm may occur if we do not respond promptly.
4. Disclosure of Non-Public Registrant Information. As the sponsoring registrar or reseller of certain domain names governed by the Internet Corporation for Assigned Names and Numbers (“ICANN”), HostingCHS is required to permit third parties with a legitimate interest to access masked (non-public) registrant information subject to data subject rights under the General Data Protection Regulation (“GDPR”) or other similar privacy laws, as applicable.
5. Notice to HostingCHS Subscribers. HostingCHS's policy is to notify its Subscribers about requests for their data, unless HostingCHS is prohibited from doing so by applicable law or court order.
6. Information to be included in a request. A request for Subscriber data must include the following information:
a. Subscriber's first and last name and email address associated with the account; and
b. Domain name, username, and/or IP address associated with the account.
NOTE: A Request that only includes an IP address may be too broad and insufficient for HostingCHS to locate a Subscriber account. Include additional identifiers, such as a domain name or username, whenever possible. HostingCHS may not be able to respond to a request without this information.
In addition, we reserve the right to request a copy of the complaint and any supporting documentation demonstrating how the requested information relates to the pending litigation and the underlying subpoena.

IMPORTANT NOTE: IF YOU SEND US ANY KIND OF NOTICE BY EMAIL AND DO NOT RECEIVE A RESPONSE FROM HostingCHS, PLEASE SEND A DUPLICATE COPY BY MAIL. DUE TO VARIANCES IN THE INTERNET AND IN EMAIL COMMUNICATION IN PARTICULAR, INCLUDING THE OCCASIONAL UNINTENDED EFFECTS OF SPAM FILTERS, SENDING AN ALTERNATE FORM OF NOTICE WILL HELP ENSURE THAT HostingCHS RECEIVES YOUR NOTICE AND ACTS ON IT IN A TIMELY MANNER.
8. Fees. HostingCHS may seek reimbursement for the costs of responding to requests as required by law and may charge additional fees for the costs of responding to unusual or burdensome requests.
9. Available information. Subject to a valid request, HostingCHS may provide data as follows:
a) No Content. We will produce content-free information, such as basic subscriber information, which may include the following subject to a valid request:
i. Name
ii. Emails
iii. Date and time the account was created.
iv. Billing information
v. IP logs
b) Content. HostingCHS will only produce Subscriber Content (such as website files and email content) pursuant to a valid search warrant from an entity with appropriate jurisdiction.
