This addendum (“Domain Backorder Service Addendum”) applies to you if you purchased the Domain Backorder Service from HostingCHS (the “Domain Backorder Service”) and is incorporated by reference into the HostingCHS Terms of Service. Unless otherwise indicated, the terms defined in this Domain Backorder Service Addendum have the meanings provided in the Terms of Service. HostingCHS may modify this Addendum at any time without notice. When you subscribe and/or are otherwise enrolled in the Domain Backorder Service, you authorize and direct HostingCHS’s affiliated registrar (the “Registrar”) to attempt to acquire a domain name (designated by you) on your behalf in the event that such domain name becomes available for registration. When you place a backorder on a domain name, the Registrar will monitor and attempt to acquire the domain name for you in the event that it becomes available.
1. There is a non-refundable annual subscription fee for the Domain Backorder Service. Until you cancel or the Registrar successfully acquires the domain, the Domain Backorder Service will automatically renew for successive terms at the then-current rate. Subsequent renewals of the Domain Backorder Service are also non-refundable.
2. The Domain Backorder Service is limited to top-level domains that are available at the time of subscription through the Registrar.
3. HostingCHS , in its sole discretion, will determine the prices it will charge for the Domain Backorder Service and the terms and conditions applicable thereto, and HostingCHS may modify such prices and/or terms and conditions in accordance with this Agreement. If you do not agree to any such changes, you may cancel the Domain Backorder Service in accordance with this Addendum; otherwise, all changes will become effective thereafter, and you agree that HostingCHS is authorized to charge your credit card or other approved payment method for any new fees.
4. You agree that when your pending domain name is purchased, HostingCHS will charge you the domain name registration fee for one year at the then-current rate.
5. The Domain Backorder Service will be canceled and deleted once the domain name is purchased and issued. Multiple orders for the same domain name will be processed on a first-come, first-served basis.
6. We do not guarantee the acquisition of any domain name, and we expressly reserve the right to decline pending orders or cancel existing pending orders at any time and for any reason, at our sole discretion. If you successfully place a pending order for any domain name, you will be subject to the terms and conditions of our Domain Registration Agreement and related agreements, which are incorporated herein by reference.
7. You acknowledge and agree that the Services may involve access to Third Party Functionality (“Third Party Functionality”). You expressly agree that you will use this Third Party Functionality in accordance with the terms of any relevant third party license. Your failure to comply with any third party license may result in the immediate termination of the Domain Backorder Service by HostingCHS, the Registrar, or the third-party provider. HostingCHS does not control such Third Party Functionality and is therefore not responsible for any issues of any kind related to the Third Party Functionality. HostingCHS reserves the right, in its sole discretion, to terminate, suspend, cancel, or alter your access to the Third Party Functionality at any time.
8. Customers may cancel their Domain Backorder Service at any time through the Customer/Reseller Control Panel. If you cancel the Domain Backorder Service, the Domain Backorder Service fees are non-refundable.
