Copyright Infringement Policy

HostingCHS takes intellectual property rights seriously, and it is our policy to respond to clear notices of alleged copyright infringement. This Copyright Policy describes the information that must be present in these notices and is incorporated by reference into our  Terms of Service . It is designed to make submitting notices of alleged infringement to us as simple as possible while reducing the number of fraudulent or difficult-to-verify notices we receive. Unless otherwise noted, defined terms in this Copyright Policy have the meanings provided in the  Terms of Service .


COMPLAINT PROCEDURE:

To file a notice of alleged infringement with us, the claimant must provide written notice that includes the claimant's complete contact information and sets forth the elements specified below.

1. Name, address, telephone number, email address (if available), and physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner;

2. Identification of the work(s) protected by copyright;

3. Identification of the infringing material that you request us to remove or disable, and the location on the Internet of the infringing material;

4 Any additional information that must be included in a copyright infringement complaint under applicable law (as we may request from you as necessary)

5. A statement that you have a good faith belief that use of the disputed material is not authorized by the copyright owner, its agent, or the law;

6. A statement that the information in the complaint is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; and

7. Your signature.

Please note that you may be liable for damages (including costs and attorneys' fees) if you materially misrepresent that material is infringing your copyright. Accordingly, if you are unsure whether material available online infringes your copyright, we suggest you first contact an attorney.

HostingCHS  may respond to takedown notices by removing or disabling access to the allegedly infringing material and/or terminating services. If we remove or disable access in response to such a notice, we will make a good faith attempt to contact you and/or the administrator of the affected site or content.

HostingCHS  may document notices of alleged infringement it receives and/or on which action is taken. As with all legal notices, a copy of the notice may be made available to the public and sent to one or more third parties who may make it available to the public.


COUNTER-NOTICE PROCEDURE FOR CUSTOMERS:

Upon receiving notification from HostingCHS that a claim of infringement has been filed and/or that the material has been removed or access to it has been disabled, you may provide a counter-notification in accordance with applicable law.

To be effective, a counter notification must include ALL of the following information:

A physical or electronic signature; Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled; A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled; and Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which you are located, or if your address is outside of the United States, the jurisdiction of the U.S. District Court for the District of Massachusetts, and that you will accept service of process from the plaintiff or his or her agent.

Upon receipt of proper counter-notification in accordance with applicable law, HostingCHS will take reasonable steps to restore the material within 10 to 14 business days, unless the copyright owner initiates court proceedings to prevent restoration of the material and HostingCHS is notified of such proceedings.
